Terms and Conditions
RENT: The rent shall be paid monthly in advance on the first day of each month. In respect of any broken period a pro-rata adjustment shall be made.
BOND: A specified bond amount will be payable to secure all new Office Solutions (Virtual / Serviced).
GST: All prices quoted in this Agreement are GST inclusive.
MONTHLY PAYMENT AGREEMENT: We use an automated payment service to administer regular payments. These can be paid by credit card or direct debit (bank account). We accept MasterCard, Visa and AMEX. MasterCard and Visa will incur a 1.65% surcharge. AMEX will incur a 3.85% surcharge. A $16.50 late fee will apply if there are insufficient funds in your account in any given month.
TERMINATION: Contracts require two month’s written notification by either party to terminate this Agreement. Receipt of termination notification and the termination date will be confirmed in writing by the receiving party, within seven days of receipt. Should nLIVEn have reason to suspect immoral, unethical, illegal or fraudulent business practice it reserves the right to immediately terminate this agreement and all services being provided.
INCLUSIONS: The Tenant is entitled to complimentary access to our meeting rooms or board room (subject to availability) with complimentary tea / coffee and water, for up to four hours per calendar month (non-accumulative).
OTHER SERVICES: Tenants also have the option of purchasing additional services, as outlined in our information pack. Additional services will be charged at prices quoted within the information pack, or on a project by project basis, and will be added to your monthly invoice.
INCREASES: The Tenant shall pay during the term of this Agreement all charges for services rendered at the rates stipulated and documented by nLIVEn at its absolute discretion. The Tenant agrees that nLIVEn reserves the right to change, or vary the charges for such services upon giving one month’s notice in writing of such change, and such new charges shall apply from the date of expiration of notice.
INDEMNITY CLAUSE: The Landlord shall be expressly indemnified by the Tenant against any loss, damage which is caused by corruption of data or any loss of information from hardware, software, mechanical, Internet damage or any errors by nLIVEn. The Tenant guarantees that it will not use the Office for any immoral or illegal purposes.
INSURANCE: Any losses sustained from a burglary, theft or robbery on the property by the Tenant will not be covered by the insurance policy of the Landlord, and are the responsibility of the Tenant.
INVOICE: Detailed invoices will be emailed after the 1st of each month. Credit card processing of invoices shall occur on the 1st day of each month. Declined credit cards and insufficient funds from direct debit payments will incur a service fee of $16.50. Should payment not be receipted by the 21st of any month, for any reason, nLIVEn at their absolute discretion; may request a security deposit if late payment occurs and/or suspend or terminate all services. Any monies owing to nLIVEn for more than 21 days shall bear a fixed penalty charge equivalent to $50.00 and an administration fee at a rate of 5% on the overdue balance per month until payment. All bank fees will be paid by the Tenant. All payment queries after the 21st of the month may bear an administration fee.
GUARANTOR: In consideration of nLIVEn entering into this Agreement with the Tenant, the Guarantor, for themselves and each of their executors and administrators unconditionally agree that they and each of them will be with the Tenant jointly and severally liable to nLIVEn for the payment of the rent and all other monies payable by the Tenant and also for the due performance of all the terms and conditions on the part of the Tenant contained or implied in this document.
